These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Paranoid Inc. (“Paranoid,” “Company,” “we,” “our,” or “us”) governing your access to and use of the Paranoid Photos application, including the mobile application and any web-based application, website, or browser-accessed interface (collectively, the ‘App’ or ‘Services’).
By downloading, installing, accessing, or using the Services through any platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Services.
You may use the Services only if you can legally form a binding agreement under applicable law and comply with these Terms and all applicable laws and regulations.
Certain features may require account creation. You agree to provide accurate and complete information, maintain the security of your credentials, and notify us promptly of unauthorized access or security breaches. You are responsible for all activity under your account. We may suspend or terminate accounts that are compromised or used in violation of these Terms.
Subject to your compliance with these Terms, Paranoid grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services through supported mobile devices and/or supported web browsers solely for lawful personal purposes. You may not copy, modify, distribute, or sell the App or Services, reverse-engineer or attempt to circumvent security or encryption mechanisms, or use the Services for unlawful, harmful, or malicious purposes.
The Services allow you to upload, store, download, and share photos, videos, and other media (“Content”). All Content is encrypted end-to-end on your device before upload and remains encrypted at all times. Due to this architecture, Paranoid cannot view, access, decrypt, analyze, or moderate Content. We do not monitor Content and have no knowledge of what Content contains.
You retain all rights to your Content. However, you acknowledge and agree that you are solely responsible for all Content you upload, store, transmit, download, or share. You represent and warrant that you own or have lawful permission to use such Content and are responsible for compliance with all applicable local, state/provincial, federal, and international laws, including those of the United States and Canada. This responsibility applies regardless of Paranoid’s inability to access your Content.
You agree not to use the Services to create, upload, store, share, or transmit Content that violates applicable laws or platform policies. You may not upload, share, or distribute illegal or regulated Content, including child sexual abuse material, non-consensual intimate imagery, media depicting or facilitating illegal acts, or stolen or pirated media. You may not upload or share dangerous, hateful, or abusive Content, including hate speech, content inciting violence or discrimination, content promoting extremist or terrorist organizations, or content inciting self-harm or harm to others. You may not upload or share Content that infringes intellectual property rights, privacy, publicity, or moral rights. You may not share media without the consent of identifiable individuals, attempt to access or decrypt other users’ Content, distribute malware or malicious code, or interfere with or disrupt the Services.
Because Content is encrypted and inaccessible to Paranoid, you accept full legal responsibility for all Content and any consequences arising from its use. Paranoid cannot access or report encrypted Content and cannot assist law enforcement with Content it cannot decrypt. Law enforcement may pursue lawful process directly against you or your device.
The Services allow encrypted sharing of Content. Paranoid cannot view or control shared Content. When sharing Content, you confirm that all required consents have been obtained, that shared Content complies with law and platform policies, and that recipients may further share Content at their discretion.
The Services provide mechanisms to report offensive or abusive Content without decrypting it and to block or revoke access from other users. Reports are reviewed using metadata only. Paranoid will act within 24 hours and may impose progressive enforcement actions, including warnings, suspensions, or account termination. False or bad-faith reporting may result in enforcement against the reporting user.
Where moderation actions are taken, the content owner may be eligible to submit a single appeal. Appeals apply only to moderation decisions and must be submitted within seven (7) calendar days of notification. Enforcement remains in effect during the appeal review. Appeals are reviewed using metadata, enforcement logs, and user-provided context only; Paranoid Photos does not decrypt or review Content as part of the appeal process. Appeal decisions are final. Late appeals may be logged but are not guaranteed to be reviewed unless required for legal or compliance reasons.
The base Services of the App are free to download and use. If you choose to purchase additional storage, you may do so through tiered subscription plans that charge a monthly fee. All purchases are final unless otherwise required by law. Subscriptions automatically renew unless canceled through the web interface prior to the renewal date. You are responsible for maintaining payment information and for any applicable taxes. Paranoid Inc. may modify pricing and storage tiers at any time, but any changes will not affect existing subscriptions until renewal. Refunds, cancellations, and billing are subject to the terms used for purchase.
The web version of the Services may use cookies, local storage, or similar technologies for authentication, security, and functionality. These technologies do not provide Paranoid access to encrypted Content.
You will not use the Service for unlawful purposes, infringe intellectual property rights, upload malware, attempt to reverse engineer, or interfere with the Service. You agree not to misrepresent your identity or engage in fraudulent activity.
The Service, including software, features, interfaces, text, graphics, logos, trademarks, and content, is owned by Paranoid Inc. or its licensors and is protected by intellectual property laws.
The Service may display, link, or integrate with third-party infrastructure or services. We do not control and are not responsible for third-party failures, outages, or data loss. Your use of third-party services may be subject to their terms and privacy policies.
Your privacy is important to us. Our collection and use of personal data through the Service is described in our Privacy Policy, available at paranoid.com/privacy.
With your consent, the Service may send push notifications and request device permissions (e.g., camera, photos, location). You can manage notifications and permissions in your device settings.
We may update, modify, or discontinue the Service or any part of it at any time.
The Services are provided “AS IS” and “AS AVAILABLE”, to the maximum extent permitted by law. Paranoid disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Paranoid shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data or legal consequences arising from your Content. Paranoid’s total liability shall not exceed the amount you paid for the Services, if any.
You agree to indemnify, defend, and hold harmless Paranoid Inc. and its affiliates from any claims, damages, losses, or expenses arising from your use or misuse of the Services, your Content, or your violation of these Terms or applicable law. These obligations survive termination.
These Terms remain in effect until terminated. Paranoid may suspend or terminate your access at any time, with or without notice, if you violate these Terms or applicable platform policies. Upon termination, you must stop using the Services and delete all copies. Certain provisions survive termination.
These Terms are between you and Paranoid Inc. only. If you obtained the App from the Apple App Store, your use is also subject to Apple’s Media Services Terms and Conditions. In the event of a conflict, Apple’s mandatory terms shall govern. Apple is not responsible for maintenance, support, warranty obligations beyond those required by law, or investigating or addressing claims related to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service and Developer Program Policies. Google is not responsible for maintenance, support, or warranty obligations beyond those required by law.
If you access the Services via a web browser, Apple and Google are not parties to this Agreement and have no responsibility for the Services.
You may not use or export the Services in violation of U.S. or Canadian export laws or sanctions. You represent that you are not located in a prohibited jurisdiction or on a restricted-party list.
These Terms are governed by the laws of the jurisdiction in which Paranoid Inc. is organized, together with applicable federal laws of the United States or Canada, without regard to conflict-of-law principles.
We may update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
