This End User License Agreement ("Agreement") is a legally binding agreement between you ("User") and Paranoid Inc. ("Company," "we," "our," or "us") and governs your use of the Paranoid Photos mobile application ("App") and all related services.
This Agreement is between you and Paranoid Inc. only, not Apple Inc. ("Apple") and not Google LLC or any of its affiliates ("Google"). Paranoid Inc. is solely responsible for the App and its content, except where explicitly required by applicable law.
By downloading, installing, accessing, or using the App, You acknowledge that You have read, understood, and agree to be bound by this Agreement. If You do not agree to these terms, do not use the App.
Subject to Your compliance with this Agreement, the Apple Media Services Terms and Conditions and/or the Google Play Terms of Service, Paranoid Inc. grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on any device that you own or control and as permitted by the relevant Terms of Service from the download source, either the Apple App Store or Google Play Store.
If you obtained the App from the Apple App Store, Apple's Terms and Conditions apply. If you obtained the App from the Google Play store, Google Play Terms of Service apply.
This license does not allow you to use the App on any device you do not own or control. This license permits use of the App only for lawful personal purposes and in accordance with all applicable laws.
Neither Apple nor Google are parties to this Agreement and are not responsible for the App or its content.
In the event of any conflict, the Apple-mandated terms shall govern. Apple is not responsible for:
The App allows you to upload and download photos, videos, and other media ("Content"). All Content is encrypted on your device before upload, and remains end-to-end encrypted at all times. We cannot view, access, decrypt, analyze, screen, or moderate any Content you upload or store using the App.
Because we do not and cannot access decrypted Content:
The App allows users to locally encrypt, upload, store, download, and share photos and videos ("Content"). All media is encrypted end-to-end on Your device; We cannot access or decrypt Content and does not monitor or moderate it.
You acknowledge and agree that:
This responsibility exists regardless of our lack of access to your Content.
You agree not to use the App to create, upload, store, transmit, download, or share any media that violates any law in the United States or Canada, including but not limited to laws concerning:
In accordance with Apple App Store and Google Play Store policies and applicable platform standards, You agree not to upload, store, download, share, or transmit:
You may not:
Because Content is encrypted and inaccessible to Paranoid Inc., you accept full legal responsibility for any Content you store or transmit using the App.
Illegal Content may expose you to civil or criminal penalties, including but not limited to:
Illegal Content may expose you to penalties under Canadian law, including:
Due to the App's encryption architecture:
Law enforcement may still obtain lawful warrants or orders directed to You or Your device.
The App uses modern cryptographic methods to help protect your data, but:
We are not liable for unauthorized access due to:
All media is encrypted end-to-end on the User's device. We:
You agree to indemnify, defend, and hold harmless Paranoid Inc. and its officers, directors, employees, contractors, affiliates, developers, partners, licensors, service providers, and agents ("Indemnified Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, expenses, or fees (including legal fees) arising from or related to:
These indemnification obligations will survive the termination of this Agreement and will continue to apply even if you discontinue use of the App.
To the maximum extent permitted by law, the App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
We do not warrant that:

Both Apple and Google have no warranty obligations with respect to the App beyond any that cannot be disclaimed under applicable law. If the App fails to conform to an applicable warranty: Your sole remedy is to notify Apple or Google; whichever is applicable; which may refund the purchase price (if any).
The App may rely on third-party libraries, cloud services, APIs, or storage systems. We are not responsible for:
To the fullest extent permitted by law, Paranoid Inc. shall not be liable for:
Our total liability for any claim will not exceed the amount you paid for the App (if any). Apple has no liability whatsoever regarding the App or this Agreement.
Paranoid Inc.; not Apple and not Google; is solely responsible for:
Apple and Google have no obligation to maintain or support the App.
Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple has the right (and is deemed to have accepted the right) to enforce this Agreement against you.
This Agreement remains in effect until terminated by either party.
We may terminate your license if:
Upon termination, this license will immediately cease, you must stop using the App and delete all copies from your device, and certain obligations (including indemnification and legal compliance) will survive termination.
You may not use, export, or re-export the App in violation of:
You represent that you are not located in any embargoed country or on any prohibited-party list.
This Agreement is governed by the laws of the jurisdiction in which the Company is organized and applicable federal laws of the United States or Canada, as relevant, without regard to conflict-of-law principles.
The App allows you to share encrypted Content with other users or recipients. All shared Content remains encrypted end-to-end, and Paranoid Inc. cannot view, access, or moderate the Content.
You are solely responsible for any Content you share. When sharing media with other users, you agree that:
The App provides a mechanism for recipients to report offensive, abusive, or illegal Content. Reports are logged securely without decrypting Content.
The App provides functionality to block or revoke access from abusive users. Blocking terminates sharing links and prevents further contact.
Paranoid Inc. will review reports and act within 24 hours, including revoking sharing permissions or suspending accounts where appropriate.
A “false report” is a report intentionally submitted in bad faith, including repeated reports of lawful content. Users who submit a significant number of confirmed false reports may face progressive enforcement actions, including:
Enforcement applies to account access or usage only and does not restrict the ability to report content. We may provide information on reporting standards and enforcement outcomes in the App or related policy materials to promote transparency.
You agree that shared Content must comply with Apple App Store or Google Play policies (whichever is applicable). Violation may result in suspension or termination of your account.
Paranoid Inc. shall implement a moderation process for Offensive Content Reports that adheres to privacy-first principles and applicable laws, including GDPR and PIPEDA. During the moderation process, no party other than the content owner shall have access to the decrypted user content.
Upon submission of an Offensive Content Report by a user, Paranoid Inc. shall log the report securely. The reported content shall remain encrypted and inaccessible to moderators or third parties. The content owner shall be notified and the content marked as "Under Review".
Moderators shall review report details and user history based solely on metadata, including report reason, timestamp, reporter identity, and content type. Moderators shall not decrypt or view user media.
The content owner shall have the right to remove the content voluntarily or appeal any enforcement action within seven (7) days. Appeals shall be reviewed by a compliance officer using metadata and prior reports.
Confirmed violations shall result in progressive penalties, including warnings, temporary suspension of upload privileges, and permanent account termination for repeated violations. False reporting may result in penalties for the reporter.
Paranoid Inc. shall maintain audit logs for all moderation actions. All actions shall comply with GDPR Article 5 (Data Minimization), Article 25 (Privacy by Design), and PIPEDA Principles 4.3 and 4.7. We shall act within the service-level timeframes specified herein and in platform-specific obligations.

Paranoid Inc. may modify or update this Agreement at any time. Your continued use of the App constitutes acceptance of the revised terms.
